Will, Probate, and Trust Litigation Attorney
There are countless possibilities for a dispute to arise as a family settles the affairs of a deceased loved one. After the death of a decedent, an interested person may seek to have a will or trust declared invalid on the grounds that the decedent lacked the capacity to make a valid will or trust or was under the undue influence of one of the beneficiaries. Fraud or forgery may be suspected, or the trustee or personal representative may breach their fiduciary duty. If you have concerns about an estate administration or the validity of a will or trust, contact C.J. Hilliard Law, P.A., to schedule a consultation to discuss your concerns.
Requirements for Disputing the Settlement of an Estate
Florida has a strict filing deadline for filing a formal lawsuit contesting a will or trust. A person who wants to contest a will or trust must act before the time for challenging the document has expired. This period varies depending on the situation. Once the period has expired, however, the will or trust cannot be contested. The only persons that can contest a will or trust are those with legal standing. To have standing, you must have a direct interest in the will or trust, such as a beneficiary, creditor, the guardian of interested minors, or a decedent’s heirs.
C.J. Hilliard Law, P.A., Represents Clients with Disputes in all areas of Estate Law, including:

Alternative Dispute Resolution
We work hard to obtain reasonable negotiated settlements for our clients to avoid litigation costs. We are experienced at resolving matters outside the courtroom through settlement and alternate dispute resolution methods, such as mediation and arbitration. Alternative dispute resolution is cost-efficient, time-effective, and gives the parties control over the outcome. In addition, mediators and arbitrators can engage those in conflict to find a resolution that preserves their relationship. This method is especially useful when disputes involve family members.
