Florida has a strict filing deadline for filing a formal lawsuit contesting a will or trust. A person who wants to contest a will or trust must act before the time for challenging the document has expired. This period varies depending on the situation. Once the period has expired, however, the will or trust cannot be contested. The only persons that can contest a will or trust are those with legal standing. To have standing, you must have a direct interest in the will or trust, such as a beneficiary, creditor, the guardian of interested minors, or a decedent’s heirs.
